Welcome to The Faith Fund (thefaithfund.org), a ministry of HCJB Global (New Zealand) Trust, a registered New Zealand charitable trust dedicated to facilitating generous, faith-filled giving to advance God’s kingdom. These Terms of Service (“Terms”) govern your access to and use of our website, including any content, functionality, and services offered on or through it (collectively, the “Services”). By accessing or using the Services, including to make a donation, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
We reserve the right to update these Terms at any time. Material changes will be notified by a prominent notice on the website and, where we have your email address, by email. Your continued use after such notice constitutes acceptance of the updated Terms.

### 1. Eligibility and Account
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services or make a donation. By using the Services, you represent that you meet this requirement, have the legal capacity to enter into a binding agreement, and are not barred from receiving services under applicable law.
No account creation is required for donations. If we introduce registration features in the future, you must provide accurate information and keep it updated.
### 2. Description of Services
The Faith Fund provides a secure platform for individuals to make one-time monetary donations to support our charitable mission of stewarding resources for biblical causes. Donations are processed through trusted third-party providers (currently Stripe). We do not offer recurring donations, investments, or financial advice—our focus is on joyful, Spirit-led giving (2 Corinthians 9:7: “Each one must give as he has decided in his heart, not reluctantly or under compulsion, for God loves a cheerful giver”).
### 3. Donations and Payments
- **Irrevocable Gifts**: All donations are voluntary, final, and irrevocable upon successful processing, as they immediately support time-sensitive ministry needs.
- **Refunds**: Refunds are not available except in rare cases of processing errors, unauthorised transactions, fraud, or duress. Refund requests must be made in writing within 30 days of the donation. We will consider each request fairly and in good faith.
- **Tax Benefits**:
- In New Zealand: As a registered charity, donations of $5 or more may qualify for a tax credit through Inland Revenue (if we are approved as a donee organisation).
- In the United States: Donations may be tax-deductible if made through our U.S. partner entity.
Please consult your tax advisor. We provide receipts but cannot guarantee eligibility.
- **Fees and Taxes**: Any transaction fees charged by the payment processor will be clearly disclosed at checkout. You are responsible for any applicable taxes.
- **Accuracy**: Please ensure your donation amount and details are correct before submitting. We are not liable for errors in transmission.
### 4. Prohibited Conduct
To honour our shared commitment to integrity, you agree not to:
- Use the Services for unlawful purposes, fraud, or money laundering
- Attempt to interfere with, hack, or overload the site
- Post harmful, defamatory, or spam content (if we add forums in the future)
- Impersonate others or misrepresent your affiliation with us
Violations may result in immediate termination of access and, where appropriate, reporting to relevant authorities (Acts 20:28).
### 5. Intellectual Property
All content on the Services—including text, logos, and design—is owned by The Faith Fund or its licensors and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works without our written permission, except for personal, non-commercial use (e.g., sharing a receipt). Fair dealing for educational or inspirational purposes aligned with our mission is encouraged.
### 6. Third-Party Links and Services
The Services may link to external sites (e.g., payment processors). We are not responsible for their content, privacy practices, or availability. You use them at your own risk.
### 7. Disclaimers and Limitation of Liability
The Services are provided “as is” and “as available” to the fullest extent permitted by law. We do not guarantee uninterrupted access, error-free operation, or that donations will be used exactly as you envision (though we commit to transparent stewardship—see our Annual Report).
To the fullest extent permitted by New Zealand law:
- We exclude all implied conditions and warranties (except those that cannot be excluded under the Consumer Guarantees Act 1993).
- The Faith Fund, its trustees, staff, and volunteers shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services.
- Our total liability shall not exceed the amount of your last donation.
### 8. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or expenses arising from your violation of these Terms or misuse of the Services.
### 9. Governing Law and Dispute Resolution
These Terms are governed by the laws of New Zealand, without regard to conflict of laws principles.
We encourage prayerful, direct resolution first (Matthew 18:15-17). If a dispute cannot be resolved informally, it shall be resolved exclusively in the courts of New Zealand. Any mediation or arbitration, if agreed, will take place in Auckland under New Zealand law.
### 10. Miscellaneous
- **Severability**: If any provision is invalid, the remainder remains in effect.
- **Entire Agreement**: These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Faith Fund.
- **Force Majeure**: We are not liable for delays due to events beyond our reasonable control (e.g., natural disasters, cyber-attacks).
